Convergence: Collaboration, Co-branding and Cross-licensing (“3C”)

Our Executive Director, Ms Stella Law, has been invited to be one of the speakers on the Business of IP Asia Forum organized by HKTDC on 5 December 2019.

Since 2000, the 2-day BIP Asia Forum links up intellectual property (“IP”) owners, buyers and sellers, R&D professionals, finance and legal intermediaries, design and technology practitioners from all over the world to discuss the latest developments in the IP world, and to explore business collaboration opportunities every year. The theme of this year is “IP: Building and Innovative and Inclusive Future for Businesses”.

On that day, Stella covered the topic on “Convergence: Collaboration, Co-branding and Cross-licensing”. IP rights, whether they are trademarks, patents, copyrights, designs or otherwise, typically confer a monopoly right in favour of their owners. The concepts of Collaboration, Co-branding and Cross-licensing appear to be contrary to such interests. Stella explained the concepts, what they look like in practice and how they may be implemented contractually; and also the potential financial implications for brand values of the relevant parties entering into such arrangements. The 3C practices can help the companies to save cost, share risks and increase revenue at the same time. More investors and professionals recognize IP as an important asset of the company and use it as an indicator of the company's technological capability level. The IP could possibly affect investors’ investing incentive.

香港貿易發展局邀請執行董事羅珏瑜女士於2019年12月5日的亞洲知識產權營商論壇 (Business of IP Asia Forum, "BIP Asia")上發表演講。

自2000年以來,為期兩天的BIP Asia論壇將來自世界各地的知識產權擁有者、買賣雙方、研發專業人員、金融和法律中介機構、設計和技術從業人員聯繫起來,討論知識產權世界的最新發展並探索新的業務合作機會。

那天,羅女士在"求同:協作、品牌協作和跨牌照合作"的主題下,分享了知識產權,無論是商標、專利、版權、外觀設計還是其他形式,通常都授予擁有者有利的壟斷權。而協作、品牌協作和跨牌照合作("3C")的概念似乎與這理念背道而馳。但羅女士解釋了這些概念實際上是如何通過合同等方式實踐以及進行此類安排的相關方在品牌價值的潛在財務影響。 3C實踐可以幫助公司節省成本、分擔風險並同時增加收入。越來越多的投資者和專業人士將知識產權視為公司的重要資產,並將其視為公司科技能力水平的指標,因此知識產權可能會影響投資者的投資動機。
